Support Stronger Statewide Tenant Protections

As COVID-related housing protections are set to expire, strong tenant protections are critical to preventing a wave of evictions and homelessness due to the pandemic.

Assembly Bill 1436 (Chiu) protects tenants at high risk of eviction due to financial hardships resulting from COVID-19. If passed, the bill would prevent landlords from evicting a tenant, if their inability to pay is due to the pandemic and came during the duration of the emergency order and 90 days after the order is lifted. Once the order is lifted, affected renters would have up to 12 months to repay back rent, after which, landlords may pursue outstanding rent through civil action but may not evict the tenant on account of this back rent accrued during the duration of the emergency. This offers tenants a reasonable timeline for back payments, while allowing landlords a process to recover payments once the state of emergency is lifted without putting tenants in jeopardy of losing their homes.
